This template Copyright Licence – Language Resource (Licence) is to be used when an Indigenous Language Centre wishes to licence the use of a Language Resource (Resource) to a third party (Licensee) as part of an Indigenous language program (Program) run by the Language Centre.
This Licence assumes that the Licensee will use the Resource primarily for educational and cultural awareness training purposes. Although it will be suitable if commercialisation is only incidental to the Purpose i.e. recovery of costs in the exploitation of the Licence Rights, this Licence is not an appropriate licence if royalties are paid by the Licensee for use of the Resource. If payment is by some form of royalty mechanism you should seek further legal advice.
This Licence has been drafted on the assumption that the Creators of the Resource retain ownership of the copyright in the Resource although it is also suitable if the Language Centre is the copyright owner of the Resource. If the Language Centre is not the copyright owner, it must have the right to licence the use of the Resource. A suitable template licence can be obtained from Arts Law.
