The Commission Agreement – Public Artwork should be used when a visual artist is being commissioned by a public body, such as a local council, to design and create an artwork which will be publicly situated. It may also be useful where the artwork is not commissioned by a public entity but is intended to be situated in a publicly accessible space such as the public forecourt or lobby of a building development.
This contract template includes the most common terms which the person or organisation paying for the artwork to be made (Commissioner) and the artist making the artwork (Artist) need to consider and agree, including the process of design approval, project timeframes, variations to the design and artwork, insurance, artist payment, installation, artist attribution and use of copyright and project termination.
If the artwork is not intended to be on permanent public display, Arts Law’s sample Commission Agreement – Private or Commercial Artwork may be more appropriate.
