This sample CAST & CREW AGREEMENT (WITH DEFERRED FEES) should only be used when a producer (Producer) is engaging cast or crew members (Contractor), as independent contractors rather than employees. It is only suitable for the production of a very low (or no) budget film or video. It is for the situation where the parties understand and agree to participate based on the presumption the film will not generate a profit, but that in the case it does, there are terms outlining how and when the cast and crew will receive a share of any profit. Funded film projects may be legally obliged to follow, or should strongly consider using the relevant industry contracts as drafted by the Media Entertainment and Arts Alliance (MEAA) and Screen Producers Australia (SPA).
